Terms of Service

Book Local Plumbers is a free referral service that connects homeowners and other consumers with independent local plumbing service providers (“Service Providers”). We are not a plumbing contractor, and we do not perform, supervise, or guarantee any plumbing work. Some Service Providers pay a fee to receive referrals through the Services.

Book Local Plumbers does not sponsor, recommend, or endorse any Service Provider, and makes no representation regarding the competency, licensure, insurance, trustworthiness, or quality of work of any Service Provider. You, and not Book Local Plumbers, are solely responsible for assessing any Service Provider you choose to hire, including verifying that the Service Provider holds any license and insurance required for the work performed.

Any agreement for plumbing services is solely between you and the Service Provider. Book Local Plumbers is not a party to those agreements, does not set Service Provider pricing, and is not responsible for any dispute between you and any Service Provider. The ultimate terms of any services provided to you will be determined by the applicable Service Provider.

The Agreement is the entire and only agreement between you and Book Local Plumbers with respect to your use of the Services, and supersedes all prior or contemporaneous agreements and understandings with respect to the Site. We may amend the Agreement from time to time in our sole discretion; provided that any amendment to the dispute-resolution provisions shall not apply to disputes arising before the amendment. The latest Agreement will be posted on the Site, and your continued use of the Services constitutes acceptance of the Agreement then in effect. If you do not agree with a change, your sole remedy is to stop using the Services.

The Services are available only to individuals who can form legally binding contracts under applicable law, and are not intended for use by anyone under eighteen (18) years of age (or the age of majority in their jurisdiction, if greater). By using the Services you represent that you meet these requirements.

When you call a number displayed on the Site, we may collect and route your call, and share your information with a Service Provider serving your area, as described in our Privacy Policy. Calls may be recorded or monitored as described in the Privacy Policy. You agree to provide accurate and current information in connection with your service requests. Book Local Plumbers does not guarantee that a Service Provider will be available in your area, respond within any particular time, or agree to perform any particular work.

In connection with your use of the Services, you agree not to:

• Use the Services for any unlawful purpose or in violation of the Agreement;
• Impersonate any person or entity, or submit false service requests;
• Interfere with or disrupt the Site, or the servers or networks connected to it, or attempt to gain unauthorized access to any portion of the Services;
• Use any robot, spider, scraper, or other automated means to access, index, or reproduce the Site or its contents, or circumvent its navigational structure;
• Copy, frame, or mirror any part of the Services, or use metatags or other devices referencing the Services to direct any person to another website;
• Modify, adapt, sublicense, translate, sell, reverse engineer, decompile, or otherwise disassemble any portion of the Services;
• Transmit any viruses or other code designed to interrupt, destroy, or limit the functionality of any software, hardware, or telecommunications equipment.

Engaging in prohibited conduct may result in immediate termination of your access to the Services, and we reserve the right to pursue all available legal remedies.

You are granted a non-exclusive, non-transferable, revocable, and limited license to access and use the Services for your own personal, non-commercial use in accordance with the Agreement. Book Local Plumbers may terminate this license at any time for any reason. The content, organization, graphics, design, compilation, and other matters related to the Services are protected under applicable copyright, trademark, and other proprietary rights, and are the property of Aptitude Media Inc or its licensors. Copying, redistribution, publication, or sale of any part of the Services is prohibited, and you acquire no ownership rights in any content viewed through the Services. All trademarks appearing on the Site are the property of their respective owners.

We reserve the right, in our sole discretion, to edit or delete any content appearing on the Site, and to modify, suspend, or discontinue any aspect of the Services at any time without notice or liability.

You agree to indemnify and hold Aptitude Media Inc, its parents, subsidiaries, and affiliates, and each of their respective members, officers, directors, employees, and agents, harmless from and against any and all claims, expenses (including reasonable attorneys' fees), damages, suits, costs, demands, and judgments made by any third party due to or arising out of: (a) your use of the Services; (b) your breach of the Agreement; (c) any dispute between you and any Service Provider or other third party; and/or (d) your violation of any rights of another person or entity. Each of the foregoing persons and entities shall have the right to assert and enforce this provision directly against you on its own behalf.

The Services, and any products or services obtained through them, are provided on an "as is" and "as available" basis, and all warranties, express and implied, are disclaimed to the fullest extent permissible under applicable law (including, without limitation, warranties of merchantability, non-infringement, and fitness for a particular purpose). Without limiting the foregoing, Book Local Plumbers makes no warranty that: (a) the Services will meet your requirements; (b) the Services will be uninterrupted, timely, secure, or error-free; (c) any Service Provider will be available, qualified, or able to perform any requested work; or (d) the results obtained through the Services will be accurate or reliable. No advice or information, whether oral or written, obtained by you through the Services shall create any warranty not expressly stated in the Agreement.

You expressly understand and agree that Book Local Plumbers shall not be liable to you or any third party for any direct, indirect, incidental, special, consequential, or exemplary damages — including damages for loss of profits, goodwill, use, data, or other intangible losses, and including any damages arising from work performed or not performed by any Service Provider — to the fullest extent permissible by law, arising out of: (a) the use of, or inability to use, the Services; (b) any transaction or relationship between you and any Service Provider; (c) unauthorized access to or alteration of your information; or (d) any other matter relating to the Services. This limitation applies to all causes of action in the aggregate. If applicable law does not permit these limitations, the maximum aggregate liability of Book Local Plumbers to you under any and all circumstances will be five hundred dollars ($500.00). Some jurisdictions, such as New Jersey, may not allow certain limitations on liability, and in such jurisdictions our liability is limited to the maximum extent permitted by law.

You hereby release the Covered Parties from any and all obligations, liabilities, and claims in excess of the limitations stated in this Section. The negation of damages set forth above is a fundamental element of the basis of the bargain between you and Book Local Plumbers, and the Services would not be provided to you without such limitations.

The Site may link to or refer you to third-party websites or resources, including websites of Service Providers. Book Local Plumbers has no control over such websites and is not responsible for their availability, terms, privacy policies, content, or services, or for any damages or losses arising from your use of them.

The Agreement shall be treated as though it were executed and performed in Austin, Texas, and shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-law principles.

You agree to arbitrate all claims that may arise under the Agreement against Book Local Plumbers or any Covered Party, who are express third-party beneficiaries of this provision. Any such dispute shall be submitted for resolution by binding arbitration before the American Arbitration Association (“AAA”) in Travis County, Texas or the county of your residence, in accordance with the AAA's then-current Consumer Arbitration Rules. Before commencing arbitration, you agree to first send us a written description of your dispute at Aptitude Media Inc, 2407 S. Congress Ave., STE E-135, Austin, TX 78704, and give us thirty (30) days to resolve it. For claims of ten thousand dollars ($10,000.00) or less, you may choose whether the arbitration proceeds in person, by telephone, or based only on submissions. Any award rendered shall be final and conclusive, and judgment on it may be entered in any court of competent jurisdiction.

To the extent permitted by law, you agree that you will not bring, join, or participate in any class action lawsuit as to any claim, dispute, or controversy that you may have against Book Local Plumbers or any Covered Party. This provision does not waive your right to pursue a claim individually in binding arbitration as provided above. You may opt out of this Section's arbitration and class-action-waiver provisions by mailing written notice of your decision to Aptitude Media Inc, 2407 S. Congress Ave., STE E-135, Austin, TX 78704 within thirty (30) days of the date you first use the Services.

Should any part of the Agreement be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect. Our failure to enforce any provision of the Agreement shall not be deemed a waiver of that provision or of the right to enforce it. No agency or partnership relationship is created through operation of the Agreement. Book Local Plumbers may assign its rights and obligations under the Agreement, in whole or in part, at any time without notice to you; the Agreement may not be assigned by you, and you may not delegate your duties under it. Headings are for reference purposes only.

In accordance with Cal. Civ. Code § 1789.3, California residents may file grievances and complaints with the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N-112, Sacramento, CA 95834; by phone at 916-445-1254 or 800-952-5210; or by email at dca@dca.ca.gov.
